GENERAL TERMS AND CONDITIONS OF BUSINESS

We are happy to fulfil your order on the basis of the following General Terms and Conditions of Business (GTC). Unless we have agreed to them in writing, we do not recognise arrangements which deviate from these terms and conditions.

2. Pricing

The prices at the time the order is placed will apply. The offer is non-binding. The right to
prior sale is reserved. Unless you express a wish to the contrary, if a vintage has sold out we
will automatically supply the next year’s vintage. We expressly reserve the right to change
stocks. The bottles depicted do not always show the current vintage. Please always refer to
the product text for the vintage which will be supplied. All prices are inclusive of German
sparkling wine tax and statutory value added tax.

3. Order acceptance

Conclusion of contract
Depiction of the products on our website does not constitute a legally binding offer, but a
non-binding online catalogue. By clicking on the “Submit order” button, you are placing a
binding order for the goods on the order form.

4. Shipping

Throughout Germany, minimum order 6 bottles. We apply a shipping fee of €6.95 for goods worth up to €149.00. Goods are delivered free ex house for orders over €149.00. Shipping to Benelux countries available for orders of 12 bottles or more, plus shipping costs of €9.95 per 12 bottles.
The customer is obliged to confirm the quantity supplied when delivered by post, parcel service or courier by signing the corresponding delivery note. By signing, the customer
declares that the quantity supplied corresponds to the quantity ordered.
Alternatively, you can collect orders free of charge from the winery. If you collect your order, we will apply a 5% discount to orders exceeding €100.00.

5. Payment, retention of title

Our invoices are payable in full within 14 days of receipt of goods. If payment is late, we will
charge interest for late payment at 3% above the German Federal Bank base rate from the date payment is due. We reserve the right to request payment in advance for new customers. The goods will remain the property of Weingut Max Schell until payment is
received in full.

6. Youth protection policy

In accordance with the German Youth Protection Act, we will not supply wine to young
people under the age of 16. We will not supply spirits to young people under the age of 18.
By placing the order, the purchaser confirms that he/she has attained the age required by
the German Youth Protection Act.

7. Warranty and Code of Conduct

You are due the statutory warranties.

8. Place of performance

The place of performance for supply and payment is our place of business in Rech.
The place of jurisdiction for both parties is Bad Neuenahr-Ahrweiler.
German law will apply.
